Detailing Understandable Rights Packages - Editorial Covers

Consider this - You're called to shoot a magazine cover. Your marketing paid off, and you have fees and expenses that fit the clients' budget, and are fair to you.

How do you define your rights package so you and the client understand it. Simple. Speak the same language. Use PLUS. (Check it out - it's free for you as a photographer to use!)

Here are a few ways you could define your contract:

In their "PLUS Packs" category, they have a package of rights for the cover. It is:
Periodical Cover - One Issue (PPCO)
Use on the cover of a magazine, newspaper or journal. Applies to a single printed issue of a periodical. Includes distribution of same issue on publisher's website. Allows reproduction of cover for promotional purposes.

You define the following:

Duration, PLUS Region, Region Constraints, End User, Product or Service Name, License Start Date
So, your license might read:
Produce one portrait of {subject} on September 1, 2007, for ZYQ Magazine cover. Rights granted are: Periodical Cover - One Issue (PLUS PACK:PPCO), beginning October 1, 2007 in the United States, for ZYQ Magazine.

In addition to that information being on the front of your contract, under a field like "Description of Assignment and Rights Licensed", you would want to include that text into the metadata of the image you are sending them. While future metadata templates and fields will make this process easier, for now, It could well look like this (click to see larger):

In the rare case that your publication is akin to People, and People En Espagnol, your license should then include a language specification, and could then read:
Produce one portrait of {subject} on September 1, 2007, for ZYQ Magazine cover. Rights granted are: Periodical Cover - One Issue (PLUS PACK:PPCO), beginning October 1, 2007 in the United States, English language only, for ZYQ Magazine.
Suppose though, that you're assignment is for the inside of the magazine? PLUS PACK PPIO works for you:
Periodical Interior - One Issue (PPIO)

Use on an interior page of a magazine, newspaper or journal. Applies to a single printed issue of a periodical. Includes distribution of same issue on publisher's website. Allows reproduction of page for promotional purposes.

You define the following:

Duration, PLUS Region, Region Constraints, End User, Product or Service Name, License Start Date
So, your license could then read:
Produce one portrait of {subject} on September 1, 2007, for ZYQ Magazine interior story. Rights granted are: Periodical Interior - One Issue (PLUS PACK:PPIO), beginning October 1, 2007 in the United States, for ZYQ Magazine.
What if you're client's not familiar with the PLUS glossary? You could include the cross-industry accepted definition as well:
Produce one portrait of {subject} on September 1, 2007, for ZYQ Magazine cover. Rights granted are: Periodical Cover - One Issue (PLUS PACK:PPCO), beginning October 1, 2007 in the United States, for ZYQ Magazine. PLUS Pack PPCO is defined as: "Use on the cover of a magazine, newspaper or journal. Applies to a single printed issue of a periodical. Includes distribution of same issue on publisher's website. Allows reproduction of cover for promotional purposes." For more information, visit USPLUS.com.
This additional information, whether this license, or the one below, could make it more undertandable.

Suppose though, that your client is insisting that reprint rights (i.e. being able to reprint the cover story to sell to the subject of the story for their own promotional purposes) be included? After you've determined the additional fee that should apply to this extension of the rights being granted, then try then "PLUS (Rights Ready) Packs". There, you'll find:
Editorial Front Cover (PREC)
Use on the front cover of a magazine, newspaper, book or other printed material not intended for commercial or promotional purposes. Use applies to a single issue or edition and all reprints or printed versions of the original use. Image may only be used on the front cover of the publication.

you then define:

Duration, PLUS Region, Region Constraints, End User, Product or Service Name, License Start Date
So, your assignment description on your contract would read:
Produce one portrait of {subject} on September 1, 2007, for ZYQ Magazine cover. Rights granted are: Editorial Front Cover (PLUS PACK:PREC), beginning October 1, 2007 in the United States, for ZYQ Magazine.
Or, if the definition needed to be included as we did above:
Produce one portrait of {subject} on September 1, 2007, for ZYQ Magazine cover. Rights granted are: Editorial Front Cover (PLUS PACK:PREC), beginning October 1, 2007 in the United States, for ZYQ Magazine. PLUS Pack PREC is defined as: "Use on the front cover of a magazine, newspaper, book or other printed material not intended for commercial or promotional purposes. Use applies to a single issue or edition and all reprints or printed versions of the original use. Image may only be used on the front cover of the publication." By being specific about your rights packages, it makes it so much clearer for everyone to understand, and fewer clients will be demanding "all rights" deals, when you've given them what they need, and they pay for those needs.

"Content Is King" says CNN

I'm beginning to tire of this phrase, not because it's not true (because it is), but because I keep hearing it. Back in March of 2006, Corbis Chief Executive Steve Davis, in a Business Week article "Content is King at Corbis reported "Davis...harkened back to one of the rallying cries of the '90s by quipping: 'Indeed, content has become king.'"

Gates himself is reported in TNC.net to have said "“Content is King”...Content is where I expect much of the real money will be made on the Internet..." Indeed, Mr. Gates, you are right.

The San Francisco Chronicle writes, on March 16th of this year, on the Viacom v. Google $1B lawsuit:
figuring out who is right in this lawsuit is also a no-brainer: Viacom. Is there even a gray area here? YouTube is profiting (or, theoretically could profit) from artistic content that it didn't create. It's taking something that was developed by Viacom, namely a number of popular television shows, and offering them free to YouTube users. Call it what you want -- say, an infringement on our mindless fun and viewing pleasure -- but it's essentially stealing. Fair use? Uh, no. Stealing.

What's important to contemplate, at least from the perspectives of television and its future uses, is the core issue highlighted by the lawsuit. And, no, it's not the cash thing. It's the content...What does YouTube make, again? Content is king...You make the content, you wear the crown."
Youtube does not make the content, they are the delivery vehicle, and just as the drug dealer gets his car impounded, so too will delivery vehicles of the technological sort also stand to be liable, DMCA notwithstanding.

After 27 years, CNN is dumping all Reuters content, still photography, text, and video. Reuters is reporting (about themselves no-less) "This is all about us, not Reuters. This is about content ownership," CNN's spokesman Nigel Pritchard said. He went on to say "Everything is changing and content ownership is king."

So, why is it that photographers continue to simply give away their content, for a pittance? for between $200 and $400, any number of freelance photographers will give away a day of their life to chase news, signing away their content in the process to wire services. These organizations are like the medieval tax collectors, coming to my fellow creatives and taking more of their money than they have, and they feel they have no choice, yet they do. They have become, in a way, enslaved to these kings of content. Not diverse in their client base, beholden to one master, and on a whim these masters could simply tire of them, and they would have no resources to sustain themselves.

Tony Maddox, executive vice president of CNN International, said in a memo dated August 29, "It's a step forward to greater control of our editorial product, of the quality of the CNN services we provide and of our growth and success in the Digital Age."

You too must recognize the value of your editorial - and commercial - products. Moreover, you must realize that you are, in fact, creating a monetizable product, and, as such, you should do everything to protect it, from actually registering it with the copyright office, to engaging in a dialog about the nature of a rights package a prospective client wants for assignments you are to do for them

"Oh, wait, this is our fault...."

Honestly, this wasn't actually meant to be a 'pile on iStock' day, but when you have a target-rich environment, you have to make the most of it.

Last week we reported (8/24 - Getty Site - Site Down as Stock Is Down?) on the new Getty Images site as being down. Well, what happened here?

It seems that Mr. Livingstone's at it again. Where is Ranz when you need her?

I was just minding my own business, following a link from another site, and this is what I ran up against.

Perhaps it's (as reported at StockPhotoTalk) the "...Feel free to download 30 of our 60 sample photos for free and get a 20% discount on your first purchase..." server load? Or, maybe, it's because everyone's over at the iStockalypse and no one is minding the store? So, I go back to check again 10 minutes later, and here's what I get at the main site:


Down for maintenance? Isn't that what the IT department does on a Saturday night, when there is little traffic (relatively speaking)? Not on a Thursday around noon!

I guess it's a good thing that today isn't 100% royalty day!

The iStockalypse

Heading to France today, August 30th, those groovy iStockPhoto contributors are partying like it's1799, and they've "paid for the experience of shooting photography in a fun and professionally organized environment" at what is surely to be a fun-filled iStockalypse, billed as:
iStockphoto's exclusive contributors have committed themselves to our growing international community and we're proud of our ongoing professional relationship with our talented artists.

To show our appreciation, we're throwing an exclusives-only iStockalypse...We're going to be rocking one of the most diverse cities in the Mediterranean — iStock-style — and this is going to be our biggest gathering yet, with 100-plus contributors, inspectors, and staff attending from around the world.

Our eager planners have already been scouring the city, exploring shoot locations, including a picturesque vineyard and the sun-drenched nearby beaches. We're also bringing in the best equipment and experts from across the world of photography and accessories for a variety of interactive workshops and studio sessions.

We're really pulling out all the stops, booking an enormous professional film and television set, which will be divided into several studio environments with top-notch lighting. Dozens of experienced models will be on hand and we'll be providing diverse wardrobe choices for concept shots.
Does "We're going to be rocking one of the most diverse cities in the Mediterranean — iStock-style...", mean, on the cheap, for pennies on the dollar of what 'rocking it' should be?

They also say "We're also bringing in the best equipment and experts from across the world of photography..." I spoke with one of the experts they solicited to bring in, and guess what? When he inquired about what he'd be paid to travel to one of these get-togethers to teach these iStockers, all he heard on the other end of the phone were crickets chirping.

From this link, they talk all about just what the iStockalypse is:
Under savvy expert guidance, beginners and seasoned pros get to share what they know and create brilliant images with old and new friends.

Bringing together dozens of highly creative individuals in a strange city makes for some boisterous times and in order to attend an iStockalypse, attendees need to be of legal drinking age in the host city...A good sense of humor and lots of water can go a long way.
Nice. What they should write is "plan on getting drunk because we'll be 'boisterous' at times...". And that 'water' they were recommending when things don't go as planned, is probably best saved to hydrate yourself before you fall asleep inebriated to avoid a hang-over in the morning.

There's even a forum posting with tips such as:
  • If isomeone is posing a creative shot and shoots it - they should be the ones that get to upload it.
  • If someone is hooked up to strobe lights, give them space to shoot what they want during their turn.
  • If someone is hogging the lights, but incredibley creative... take a few minutes to learn from them but dont be afraid to jump in there and ask for a turn!
  • If everyone has paid to be there, they have as much right to shoot as you do, so let them, how would you feel if they kept getting in your way, or stealing models, or interrupting your shot?
  • See it like speed dating and treat it like a speed shoot where the quickest ideas are framed
  • I think if one photographer is setting up the models and the shoot, those poses and what not should be for that photographer alone...........but somehow that won't fly at a lypse event.
The iStockalypse site goes on to say:
The events transform hobbyists into knowledgeable photographers, and endow them with the skills for a professional career.

Each day iStock sets the stage for participants to launch into high-end photo-shoots...
Hmmm. Maybe they missed the ModernPostcard e-mail which billed iStockPhoto as an opportunity to "...skip the expensive photo shoot..."

I do hope that the models are not French (meaning they would have to import them from another country) because clearly Getty (yes, that would be the parent company if iStockPhoto) has had problems with French models because of the model's rights, because Getty has very specific model releases when the models are French Nationals:
The "French/France" release should only be used in France and only when using French National models. This release looks markedly different compared to the mandatory 2004 Getty Images releases, in other languages for use in other countries. It is different because French laws are very unique and specific when it comes to protecting model's rights. Therefore we have had to develop a special version for use in France with French national models.
Good luck photographers, I do hope you've looked at your ROI on this one, and bring your #2 pencil, there's an entire hour devoted to "Fill out Appropriate Forms" first thing Friday morning - what a way to start the day. Oh la la'lyspe is right. Beware the potential to be asked to reduce your commission rate because they're providing all the venues and models - read that fine print!

The 'Virus' is Spreading

Jim Pickerell is reporting that the microstock virus is spreading to Getty Images proper. Well, he didn't call it a virus, but it's appropo none-the-less. By virus I mean the iStock pricing mentality. Virus Patient zero is the former head of iStockphoto - Bruce Livingstone. It was indicated when iStock was aquired that he was to remain at the helm of iStockPhoto. Yet he has succeeded in bumping Getty's web guru as SVP of Technology Linda Ranz just weeks before the new site launch so that he is now SVP of Technology, in addition to his remaining as CEO of iStockphoto.

It's worth noting that Ranz was at Getty beginning in November 2006, and here JDK says of her "...Linda has had a spectacular career at Getty Images...". Hmmm, I doubt that anyone would suggest that a 10 month stint anywhere is a "spectacular career"). Like Jim Jones before him, Livingstone is passing out the purple kool-aid, and people are a drinkin'. According to Pickerell:

"Getty Images has announced a new Web-use price of $49...Getty believes this new low price will help it capture a portion of the market that might otherwise go to competitors...Image suppliers should find it easy to gauge the success of this initiative by watching their sales reports and comparing the volume of units licensed with previous orders."
Volume of units licensed? Yes, but how many units must be licensed at $49 to arrive at the revenue previously? (Revenue, as in, cash paid for image license = profitability, etc) This seems like it could be a fake-out to artificially increase a line item in a quarterly report listing the number of images licensed for what will otherwise be a lackluster quarter for GYI, perhaps?

Tuesday, Andy Goetze over at StockPhotoTalk ,wrote:
Getty Images is "slicing off a portion of its portfolio to sell as midstock [under the new RF brand Valueline starting on August 31]. 100,000 royalty free photos will be removed from the bulging Getty portfolio to be sold under the Valueline brand at Punchstock.com. The images were all created prior to December 2005 and are drawn from various collections that Getty owns or markets for the photographers. Prices start at US$19 for a small web-sized image. All other sizes are US$49."
So, it's not bad enough that it's $49, it's actually as low as $19. Welcome to the world of "midstock". Welcome to the alternate reality that is JDK's World.


CORRECTION: We originally listed Livingtone as CTO, he's not. He's still CEO of iStockphoto, and is now SVP of Technology too, as was Linda Ranz SVP before she got the boot.

iStockPhoto - 100% Royalty Day

Why, oh why, is iStockPhoto running "100% royalty" days? iStockPhoto forum member LeggNet wrote on Friday, August 24th, at 10:08PM:
"I count the extra $75 I received today from "100% royalties day" as a nice special"
According to PDNPulse, which reported on July 20th, that this would happen in the next two months, it apparently did, on or about August 20th, according to their forums, but only if you're an exclusive istockphoto contributor, otherwise, it's just 20% for you, with no 100%. Of note, from their press release, was an interesting figure - 2,300 - "...All 2,300 iStockphoto exclusive members...", meaning, that there are only 2,300 members (apparently worldwide?) that are exclusive, yet they gave out $100,000 extra that day. That amounts to about $43.48, on average, additional per day, to each exclusive member. Above, LeggNet got $75. Somewhere, there's some reverse-engineering worth doing there to determine the monthly revenue by iStockPhoto, and the 2,300 exclusives, to the quantity of non-exclusives, to determine just how good bad things are over there.

Photo Business News & Forum - Updates and Enhancements

Things are hopping right along here at Photo Business News & Forum. Because a number of the recent postings have been rather lengthy, and caused other stories of interest to bump to the second page, I've taken a page (or, rather, a few pages) from the world of print, and 'big league' bloggers, and instituted the 'jump' concept. So, after a paragraph or two, and a graphic or two, you'll be given the opportunity to delve further by clicking on the "More: Full Post and Comments" link, taking you to the rest of the story. This will allow for more posts to remain on the "front page" longer, for you semi-daily visitors to check out. At the landing page, you'll also be able to see reader comments, and hopefully add your own. JDK's World

If you're looking for a straight-up biographical sketch of Jonathan D. Klein, look elswhere. According to his employment agreement with Getty, he's "is viewed as an expatriate on assignment" over here in the US of A, from the UK.

Instead, JDK must be an ex-pat from an off-world colony, or a parallel universe, JDK's World, if you will. There are a number of JDK-isms. To wit:
  • Of Linda Ranz - "Linda has had a spectacular career at Getty Images and her contribution to the success of the business, in a variety of roles, has been enormous." This, after she had been there only 10 months, during a time when the stock plummeted. Where else is a 10 month run seen as "spectacular", other than the alternate world that is filled with show tunes called Broadway?
  • PDN reported "Klein also revealed that a glitch in Getty's online footage search led the company to lose about $1.5 million in revenue. 'The bad news is that it happened. The good news is that it has been fixed since them,' he said." Really? As Ismay suggested to Captain Smith to increase speed the bad news is a navigational glitch has been revealed, the good news is, we won't have to discuss it in a few days, might have been a comparable conversation. "Glitch" and a "$1.5 million" loss are not equatable to one another.
  • About criticisms of JDK/GYI/et al, he said "There could even be some wild speculation about our business and our prospects. My advice is simple -- ignore it." Really? Ignore your critics? At your own peril in this world, but it is commonplace in la-la land (aka Hollywood), and you see how much many of those films loose. When studios know they have a bomb, their surefire method is to not make the film available for a preview for the critics, or, better yet, praise the fake critics. So, I say again - ignore your critics at your own peril in this world.

PDN reported back in July:
Jonathan Klein...plans to work from New York for nine months beginning in September...Officially, Klein is coming to New York so he can connect with Getty customers, who include many media and advertising firms in New York...Unofficially, we know New York is a great place to talk mergers and acquisitions. Klein has said Getty wants to acquire more companies and expand into new services.."
However, it could be that the cocktail/party circuit in Seattle is a bit lacking, and Klein is, instead, looking to have a well-shaken Martini as he increases his visibility among other Wall Streeters who might, instead, give him a new lease on life at a new company, perhaps? If you can't change the world you are in, at least change cities (and hopefully jobs). This is one aspect of JDK's World.

Those aren't tinted spectacles he wears, they're full-on reality-shifting spin-meistering beer goggles, where JDK's World does not look like our own.

A few questions remain:

Did JDK's World export the phrase and mentality "loose a little on each sale, but make it up in volume?"

In JDK's World does the formula A-L=OE work?

In JDK's World is the common investment strategy to short, rather than seek increased value? If so, a drop from $90+ to $30+ in such a limited timeframe should be cause for celebration!

In some areas of this world, "Profit" is a bad word. Is that so in JDK's World?

In JDK's World, is up down, and down up? Can if be found down the rabbit's hole", or through a side door in the WWCF?

Perhaps, instead, JDK has figured out the theory of the universal wavefunction and has finally figured out the deterministic equations to solve non-deterministic events, which, of course, would be a boon to this world, to be sure.

Modern Postcard - Round Two

What a difference a (business) day makes. As I wrote on Friday, Modern Postcard made a monumental error. Judging from e-mails I recieved alone (over 30) with photographers who sent e-mails to MP expressing their displeasure and cancellation of jobs in process, by yesterday, they had clearly heard the cacophony of voices. ASMP and APA members pummeled them on their listservs, photographers at Sportshooter and numerous places elsewhere, all were espousing other printer solutions. Organizational leadership also reached out to enter into a dialog.

Now, the worm has turned. Intrepid reporter Daryl Lang over at PDNPulse confirmed that Modern Postcard has ended it's relationship with iStockPhoto, with this entry, writing "Now Modern Postcard has gone one step further and ended its affiliate relationship with iStockphoto, PDN has confirmed..." on the PDNPulse blog (with Lang kind enough to link to this blog - thanks Daryl!). He states that he'll have a full story on PDNOnline soon.

Modern Postcard took action, and should be applauded - and forgiven. They made a mistake, and yes, they should fire that marketing person still, however, they didn't just say they were sorry, they severed their business dealings with a detriment to the professional photographic community. They did the right thing. Should they have not done it in the first place? Of course, however, forgiveness is the gracious thing to do.

DECISION? iStockPhoto KO'd.

"Skip the expensive photo shoot..." - What the #%^@ !

This section of a newsletter (at right) landed in my inbox lat night - 8/24 at 5:00:26 PM EDT because I am a past Modern Postcard client, and then at 9:23:16 PM EDT, my inbox gets the following below:



One of the sentences in it is:
we stated to "skip the expensive photo shoot" by using iStockphoto instead. We sincerely apologize as this miscommunicates our intentions and our feelings about professional photography...The two co-founders of Modern Postcard started their careers as photographers and are intensely loyal to the photography profession.

They go on to stand by the statement with the excuse:
The target audience of this service is small / home office businesses on a limited budget that have never been able to afford quality photography and therefore have never used it.
No, your "target" audience was the revenue that your photographer "friends" earn serving these businesses, and I got one, so the e-mail blast certainly wasn't targeted at all. Further, I have, in the last six months, done assignments that were portraits of home office business owners and other small businesses, and let me tell you, setting up a 9 foot seamless in someone's living room for a full length portrait isn't easy.

When you say:
We enjoy a strong relationship with the artistic community and will continue to do everything possible to help them promote their talent and grow their businesses.
you can start by firing the marketing person who allowed this nonsense to occur in the first place. This would fall into doing "everything possible." Your staff should be keenly aware of the landscape of it's clientele, and the challenges we face - and the problems with microstock are well publicized to be sure.

Getty Site - Site Down as Stock Is Down?

I happened to be headed to the Getty Images site at 8:14pm EST tonight, and found this: (click the graphic to see the screen grab full size (two screens long):

All the sites - United Kingdom - gettyimages.co.uk; Deutschland - gettyimages.de; España - web gettyimages.es; France - gettyimages.fr; Italia -gettyimages.it; Japan - gettyimages.co.jp; and, Brasil - gettyimages.pt, were listed, and the message included in their respective language:
The new gettyimages.com is temporarily unavailable as we are updating the site. Please visit us again -- we will be back online soon.

Hmmm, it seems like a pretty bad time to have dumped the lead on your website, don't you think? I think I made that point in a previous post on the same subject. A read of the links that you are directed to are:

So, Getty is sending people to the "legacyeditorial" site? What gives? Note the blue "?" box -- that code is supposed to call:

Heck, they can't even get a 'spacer.gif" graphic right! Really, what gives?

So, why was I headed to the Getty site? To look for the date of their next quarterly report. I thought it interesting to note that the last time I commented on their stock price, they were at $34.59, and it closed today at....drumroll please.....$31.13, or $3.46 down, exactly 20% down from 8/4, and today is....another drumroll.....8/24, or, 20 days. That's 20% down in 20 days, and that's not even 20 trading days! Heck, I guess I don't have to wait until the next quarterly report, at this rate, they'll be a penny-stock before you know it. Oh, wait, they already have "penny-stock" covered, it's called iStockphoto, with just pennies on the dollar going to the creative talent behind the images they proffer.

Shorters, start your engines!

Update: When I checked back at 9:06, the site was back up.

Throughout the Universe, In Perpetuity....Yuck!

Previously I wrote the introduction to Ed Greenbergs' missive (When Your Agent is Not Your Friend), which talked about the agency-photographer relationship, and was critical of organizations like Corbis.

ASMP wrote back in 2001, about the Conde Nast contract, in part:
" This contract gives Condé Nast the right to license virtually unlimited additional use, in both conventional and digital media, of the images that were purchased initially for editorial use in their magazines. Condé Nast also reserves the right to prevent the photographer or illustrator from licensing any commercial or advertising use of the image, even long after Condé Nast's license is no longer exclusive...With the impressive list of titles that Condé Nast publishes (Glamour, Mademoiselle, GQ, Gourmet, Vogue, Vanity Fair, Architectural Digest, The New Yorker, Traveler, House & Garden, Brides, Self, etc.),"
and so many photoragraphers were still signing up, with a contract that included the granting of rights to the assignment images "throughout the universe", and "in perpetuity". Imagine the gall! Yet, it clearly didn't offend a lot of people who were more than willing to sign off on such offensive contract language.

So, what does Conde Nast pay? $350 a day for an assignment. The photographers I know who have signed this justify it by suggesting that it gets them other jobs and exposure, or that $350 plus the fact that you can bill for every little thing under the sun from camera rentals of your own equipment to each individual sand bag, to a cup of coffee, helps you to make it all up in the end. I don't think so, really. I find it absolutely insulting that I am told what I am to be paid regardless of my skill set, and then I must scramble around and bill for each and every C47, gel sheet, quarter-in-the-meter, cell phone call, and so forth.

Back in July, "Keri", over at the PDN forums wrote:
I photographed for a Conde Naste publication over 2 years ago, now they are recalling the film to run the story again. Shouldn't they pay a page rate fee again? or at least a research fee? When i asked on the phone they said they didn't pay anything.

And then, after two responses, wrote back on the thread:

After some research, i think i may not have any right to payments from out takes from my shoot due to the shady and tricky wording of the Conde Nast contract i signed. Aparently it is the worst contract for photographers out there. I guess i can just refuse to send the photos. It's a lesson out there for photographers to read their editorial contracts thoroughly.

Keri continues:

The problem is this, in the Conde Nast contract it has wording that essentially gives them first publication rights on all images made during the shoot indefinitely, so of course they are not going to run the same image but an out-take from the shoot.

and then, at last:

I even read somewhere how Conde Nast was trying to sell photo's as stock and not compensating the photographers. don't know if that really happened though.

Indeed, Keri. And thus, you are required to re-serve the client, at no additional charge to them, and a significant outlay of time and energy on your part. This point is worth re-stating. You don't get a research fee paid to you, nor anything else for your troubles when they recall an assignment. Nothing.

Enter Corbis. Today in my inbox lands this:


And the text reads:

This is what happens when you sign a contract which grants them all rights "...throughout the unverse, in perpetuity...". And don't worry, if it's just Womens Wear Daily now, soon it'll be every other one in the stable of publications. WWD is probably just a soft launch to see who will complain - not that they have any standing to do so.

From a business standpoint, part of me wants to applaud Corbis for securing the rights to this archive. To them, it's like walking out your doorstep in the morning and finding a lottery ticket worth millions just staring you in the face. Yet, I am sure that the Corbis-Conde Nast negotiations were brutal, arguing over such things as percentage domestic, international, and, of course, the uses off-planet that the photographer has just given away. I can't wait to see the moonscape dotted with billboards using images from the Conde Nast library!

So, when that mousepad, poster, or limited edition signed print by the subject is out there being sold, because a deal was cut with those depicted, you, dear contract signer are left twiddling your thumbs, and, if you wanted one of these items, get in line to buy it, you're SOL otherwise.

Oh, and remember Apple Computer using the images for their "Think Different" campaign, of people like John Lennon, Albert Einstein, and others? Those types of uses will continue, with artists (or their estates), Corbis, and Conde Nast getting paid, but again, start twiddling your thumbs, you'll get zero. This alone should get you, dear reader, to start "thinking different" about signing this contract.

To the photographers who signed these deals, don't complain, you knew better. If you got a call from a Conde Nast publication, it was because you were good and talented, with experience. Atleast most of you were smart enough to know about the industry-wide criticism by ASMP, and others, about just how bad this contract was. You knew what you were getting yourself into, and giving away - dare I say, selling your soul?

If you're not complaining so be it, pretend that you never read the above, carry on, nothing to see here, move along. If you are, well, don't waste your breath, unless it's telling the Conde Nast family of publications that you won't work under terms like you have been now that you see they are relicensing (and recalling) your assignment work, to sell your work as stock, the next time they come a callin'.

The Associated Press and Commercial Assignment Work

So, a colleague forwarded me a promotional e-mailing for commercial photography services, promoting a case study of their "83 locations one week" project for UPS. From the mailing:
Assignment: UPS 100th Anniversary Tour
For the Centennial Global Tour, UPS marketing agency The Spark needed photographs from around the globe for a traveling exhibit showcasing exceptional employees who embody UPS values.

With a one week deadline, The Spark and UPS turned to AP Images to capture the spirit of these celebrated individuals in over 80 UPS locations around the world.

Locations: 83 locations
Deadline: 1 week


Results: By utilizing our global network of photographers and AP bureaus, AP Images quickly assigned photographers in the designated locations. Each photographer was able to capture the employee at their UPS location and quickly transmit the photos. The assignment was completed on time and on budget.

The photographs are the centerpiece of the UPS Centennial Global Tour, which will travel to UPS locations around the world and will also be made accessible to the general public throughout 2007.

It then goes on to talk about "AP Images", which is a division of the AP that not only has the library, but is not being aggressive in their outreach to produce commercial photography:

I can't image that they'd send out their $200 a day all rights all expenses included photographers to shoot these types of assignments, but who knows, maybe they did. If so, and if each commercial portrait assignment was priced appropriately (i.e. at the low end, $1,500 or so), that's one hell of a markup for the AP, and if they are paying their assigned photographers an appropriately negotiated assignment rate, and taking an appropriate comission and then further representing those images in their library for future licensing with a traditional photographer/agency split, then I think that's a good thing.

One concern I have, is it says "...By utilizing our global network of photographers and AP bureaus...", so, the AP bureaus, which are news bureaus, are now serving as commericial photography assignment offices? Are the AP staffers being used? Is this a violation of their guild/union agreement? How are they being additionally compensated if they are being used? Or, are the bureaus calling upon their stringers to do this work? Lastly, could these commercial endeavors risk any non-profit status that the AP enjoys?

With Digital Railroad launching their Marketplace in beta 9 months or so ago, and entering v1.0 back in April, I thought I’d take a look at how they’re doing, based upon my own experiences, client experiences, and so on. I’ve broken down the piece into several pieces, as it’s rather lengthy.

Digital Railroad’s Marketplace - Overview

Back when DRR launched their Marketplace, I wrote about it on April 11th, 2007 (The Marketplace is now Open). I had previously uploaded a collection of my archives to them – all analog scans from my film days, as well as some of my more current digital imagery, Keyworded, properly captioned, and so forth. I did this prior to the Marketplace launch, and the images were not exclusive to them. For instance, you can find them as web galleries here on my site, which are search-engine-friendly, and, for example, some of my White House work from an assignment for National Geographic’s television channel as their unit photographer can be seen here on PhotoShelter. I didn’t know what to make of the Marketplace, beyond the standard hype that accompanies any corporate product launch. Will it succeed in general? Will it serve itself, or photographers? And, the proverbial “if you build it, will they {clients} come?" I don’t care how great an archive there is, if prospective clients can’t find you or your images, there’s no sale. So, how do freelancers feel about it? Are they making money? And, how do clients feel about it? Are they getting the imagery they need, and are they paying fairly for it?

Following are a few client and photographer experiences that should be insightful, as well as insights into how they’re getting the word out (on their photographer’s behalf), and my summary thoughts.

Digital Railroad’s Marketplace - Getting the Word Out

So, how do those buyers know that the Digital Railroad Marketplace even exists? They, of course, have a blog. They also are making outreach to photo editors with stories of fresh/unique content via their marketing resources which go out multiple times a month – their August Buyer Newsletter can be seen here. They also have a Buyer Benefits section of the site so that buyers know how the Marketplace can work for them.

In addition, their Railmail gets you “a quick overview of a recent selection of requests”, including:
  • Caribbean Islands: Martinique and Trinidad/Tobago
  • Las Vegas
  • Pench India Tiger Reserve
  • Editorial images: Cairo people and location
  • Winter and Christmas images; contemporary and vintage (for French agency)
  • Health Care: Adult in hospital bed with grieving family
…and so on.

This is a similar type of list I used to get from my agency which let me know where holes were in the library that I could fill, if my creativity so inspired me.

What hasn't, heretofore been known (atleast it's not been promoted as a marketing channel by them) is, for example, this search for the search term "/drr.net" yields some interesting results about their marketing strategy. They're investing in Google Adwords, not on specific Google page return results, but rather, on content-relevant pages. Definately stealth marketing of images. So, for example, on "Les Celebrites.fr", a French site about celebrities, their index for "Michelle Yeoh" contains Google Adwords for images of Michelle Yeoh at Cannes, as noted at right.

On a much more public note is their sponsorship of the Aperture Users Professional Network Road Tour, which sold out in NYC a few weeks ago, has been to Boston, just wrapped here in DC, and is enroute to San Diego, For Lauderdale, LA, New Orleans, SF, Chicago, Dallas, and Seattle.

So, it is working? Check the client and photographer experiences for more on results.

I wrote previously about Digital Railroad being the provider of the back end capabilities for the New York Times digital archive in my article on July 30th ("Reelin’ in the Big Fish”), and that trend seems to be continuing.

For nearly 60 years, DDB has been at the forefront of the advertising game, and I have had the privilege of working with them on a couple of the Milk Moustache campaign pieces, and they are also responsible for the “Hey, let’s get Mikey to try it. He’ll eat anything” cereal ads; The infamous Gorilla with Tourister luggage ads that lead to our common notion of today that airline baggage handlers are gorilla-esque; and the “Did Somebody Say McDonalds” campaign. You get the point – they’re the real deal, and, as one of the bigger ad agencies, they’re one of the many clients that peruse and license from the DRR Marketplace. Tracy Guza is a manager in their Seattle office. Tracy says, of her initial licensing from DRR “…We have been asked to use more varied and unique imagery in our direct mail and Digital Railroad is one vendor that offers an alternative to the norm…”.

Frommers, the highly regarded travel guides (which have safely guided me on assignments around the world over the years), also has hopped aboard Marketplace. One of their Senior Photo Editors, Ricard Fox, said of DRR, “ I look at thousands of photos that are used on book covers and interior photos, for over 200 books a year. Digital Railroad appealed to me for their edgy and fresh imagery… having this resource in my arsenal is a huge bonus.”

So, it seems that clients are happy and satisfied, and, more importantly, now that it's built, they are coming. While DRR is closed-lipped about how fast and how much exactly (and that's the million dollar question - literally) the answer remains to be seen.

When they launched, I was a believer in the concept of paying a monthly fee to have my images online, and downloadable. As with my website, which was originally designed not “to be found”, but rather, as a URL I could provide to prospective clients to look at my work, rather than ship my portfolio. It worked great, and I got many a job from that. It wasn’t until later, that my site began ranking on the search engines, which brought in a huge amount of unanticipated assignments. As with my website, I kicked off my subscription to DRR before the Marketplace launched, to be able to serve my clients who wanted downloadable, secure access to the images I had shot on assignment for them. It is also important to note that at the same time, I also signed up with PhotoShelter, which I maintain today, as well. Whenever I was asked if I was making money off of having my images on DRR, I’d respond that that wasn’t where my sights were set – I was using them to service client review needs, and that was working great, and since that service is a part of my billable post-production workflow, the costs were covered and it was a profit center for me. Yes, there was a learning curve for the clients (and to some degree, there still is), however, it does work, and they are learning. As I was trying to get away from my aging transparencies and negatives, I began the arduous task of scanning and keywording them. I bought David Riecks’ Controlled Vocabulary’s software, which worked great, and made keywording not only so much faster and more efficient, but also, through the process, taught me to think in keywording terms. However, I just didn’t have the time or staffing, to scan in medium format images, so I outsourced that, as well as the keywording and analog-to-metadata caption transfer to Jaincotech’s Gautam Pai, who’s team did a fine job, and for a remarkably good price (which, by the way, is actually much lower now than what I paid even 9 months ago!). I uploaded those results, as well as the in-house produced 35mm imagery, which I could justify doing myself. When Marketplace launched, I had a solid collection of images, but I had no idea as to potential buyers. Sure, there were promises about a broad buyer base by DRR, but would the press release even come close to reality?

Enter Stephanie. One of DRR’s sales team members. It was 9:12 am east coast time a while back, and an e-mail hit my inbox from her looking for a variation on the image that I had shot for a magazine cover of Jamie Rubin (the one image I had was the one at left), at the time, the spokesman for the Department of State. Who knows what he’s up to now, but apparently, a newspaper in the United Kingdom was interested in what I had, and if I had any more. According to the email from Stephanie, the client “…is really after something more casual / less posed, do you have any other more casual shots…”. Sadly, I had two things working against me – 1) I did not have any casual shots, as it was a very time limited cover shoot, and this was all I had, and 2) the UK was on a tight deadline, and to make matters worse, I was on the west coast packing the family into a minivan for a trek up I-5 enroute middle-Oregon during my vacation. By the time I had called Stephanie to close the loop and tell her that I didn’t have more imagery I could upload, the deadline had passed without a sale. Yet, the effort she made while I was sleeping on the west coast at 6:12 am, was most appreciative, knowing further that at about 4am my local time, someone in the UK was perusing my archive and considering licensing my work while I slept. Nice.

Then, it also cuts in my favor. An image of mine at the end of last week was licensed for $150 for a small use in an educational video – probably not while I was snoozing away this time, but certainly without any additional effort on my part. Double nice!

Digital railroad of course, must serve it self (and it's investors). However, that turns out to be a byproduct of serving up images (mine, and many others) that generate revenue for photographers. And we, in turn, get to serve up services that meet client access needs, as well as serving the secondary market for these images, post-assignment, that is rights-managed stock.

Back in the analog days, I used to consider that whenever I was sending my agent, Black Star, my images, it would be at least six months before I actually saw any revenue from them, sort of like priming a pump. Yet, that point would be arriving in October with an April “opening”, yet it’s months before that and checks are arriving - out of the gate no-less. Controlling which of my images goes on my branded site, as well as out to the Marketplace is important to me.

Am I pleased that DRR also is providing a vehicle for Royalty-free images? No. However, I think that they have to at least say that they offer that, but I hardly think that they will be able to sustain themselves on their 20% revenues from the nominal, one time revenues that RF would bring them.

It seems like this train has left the station and is full steam ahead. If you’re not aboard now, DRR and Marketplace is worth a serious look. I'd expect that, in short order, whether via additional image licensing, or as a mark-up-able service to clients, both the Marketplace and Digital Railroad's services could be a profit center for you too.

Au Contrare Mon Frere! Or, Tip for Microstockers: Don't Quit Your Day Jobs

I have great respect for my colleague Jim Pickerell. So much so that almost about a decade ago, I hired him as an expert witness. Yet, I'm going to have to disagree with his example of a microstock success - Erik Reis: Microstock Success Story, over on Black Star Rising.

I responded, in parts:
  • "microstock photographer Erik Reis is happy with his results." You cannot equate this individual's being "happy" with their results, as someone who's an example of a success story. Just as people can be successful and not happy, so to, can people - especially hobbyists - be happy and not successful.
  • Jim then writes about Reis, that he "acknowledges that only about 10 percent are good sellers." Ok, so, out of 1,338, only 133 are good sellers. That's not so good for a year's work. Even worse for two year's work. My advise to Reis - don't quit your day job.
  • Then Jim goes on to reveal "As is the case with the majority of the more than 70,000 microstock photographers, he has chosen to put the same images on many different sites."...Every stock agency (including Getty and Corbis) specifically preclude you by contract from placing the same images with them, because it's been proven to be bad for the agencies, and, as noted by clients - it's been proven to upset clients when they find the same images in searches at many different places.
  • The one shining point is the insight that iStockPhoto is not a satisfactory revenue producer, and that other smaller sites are better for them.

While I am a dual system shop right now, using Canon and Nikon systems, I am looking forward to the new D3, but it should have atleast been announced by now. Grrrrr.

My Phones and E-Mail Are Working

Dear OnRequest -

Recently I spoke with a second person who reported that you have said to them that you have tried to get in touch with me about my reporting about your failed business model(s), and my otherwise critical position about how you're trying to generate enough revenue to be: a) profitable; b) a takeover candidate, or c) ???

So, I checked, and my phones work. I looked back in all my e-mail from pre-blog launch to present, and no correspondence. And, since I actually archive my junk/trash, I checked there to. Nope. Zip. Nada. I got nothing from you.

Apparently, when you were talking to a few photographers who have expressed reservations about your business model and manner in which photographers can generate revenue from a relationship with you, your folks have come back and said things like oh, you mean that Washington DC photographer? We've tried to reach out to him, but he's not interested in talking to us. Now, that's not a direct quote (otherwise it'd be in quotation marks) but the gist of what was said to them.

If you want to get in touch with me, and provide a cogent response to what has been written and reported, please do so. However, going around and suggesting that you have done so without actually doing so is disengenuous, and quite possibly dishonest. If you'd like to respond and take apart what I've written and provide an e-mailed point-by-point response, feel free to do that too. I'll review it, and be happy to provide a follow-up piece that includes it, with any applicable commentary on my part.

The last word I heard from OnRequest was when David Norris responded to another questioner in the audience at the Microsoft Summit, who was challenging the figure Norris cited (which was somewhere above $20k if I recall) for an entire library for T-mobile to use for their new campaigns, and who was suggesting that that figure was way way too low. Whatever the actual figure, the photographer in the audience doing the challenging knew whereof he spoke when he responded that the figure was a low low low amount.

Soon I'll be reviewing what your staff has referred to as your latest contract. Supposedly, it's better this go 'round, as nothing there jumped out at the person who was kind enough to provide it. However, a contract is a form of 'the price of admission'. It gets you in the door. Next will be - how fair is what you're paying for what you're providing. Are you treating the creative talent as day laborers - paid once and never again? Or, are you paying them 50/50 or all licensing revenues as an agency, or 80% to them and 20% to you when acting as their rep? I look forward to reviewing it, and, if you actually wanted to contact me, rather than just pay that act (of picking up the phone or e-mailing me) lip service, feel free to do so. If you have concrete examples of how your business is not just serving your clients, but also acting on behalf of the photographers and creative talent that you will rely on for any longevity, I am happy to review it.
